Abuse Contact

In compliance with the 2013 Registrar Accreditation Agreement (“RAA”), MarkMonitor maintains an abuse contact to receive reports of abuse involving Registered Names sponsored by MarkMonitor. Receipt, Handling, and Tracking of Abuse Reports

Abuse complaints must be well-founded, actionable, and must pertain to a domain name for which we are the Registrar. For the avoidance of doubt, please note that the Registrant (not the Registrar) of a domain name is the owner of the domain name, and that allegations of abuse pertaining to email services or other online services run by the domain name’s Registrant most likely do not constitute domain name abuse.

In compliance with the RAA, MarkMonitor receives abuse complaints by phone or email, and must receive the complaint in writing (via email) for verification. Well-founded reports of Illegal Activity from law enforcement, consumer protection, quasi-governmental or other similar authorities designated from time to time by the national or territorial government of the jurisdiction in which MarkMonitor is established or maintains a physical office are reviewed within 24 hours by an individual who is empowered to take necessary and appropriate actions in response to the report. In responding to any such reports, MarkMonitor is not required to take any action in contravention of applicable law.

MarkMonitor treats allegations of abuse seriously and handles each one by investigating the alleged abuse in a secure manner that we deem does not threaten our systems. We may, at our sole discretion, notify our customer of the alleged abuse, and we may, in our sole discretion, work with our customer to resolve the alleged abuse. MarkMonitor will respond appropriately to abuse complaints, which may or may not include a reply to the complainant.

MarkMonitor will track abuse complaints using our internal filing processes, will maintain the records related to such reports for two years, and during such period, will provide such records to ICANN upon reasonable notice.
